Introduction (Read This First)

Welcome to the Knowledge Cosmos™ Ecosystem featuring the Knowledge Composer™, Gameblazer™ Simulator, Wisdom Elemental™, Element Castle Model™ and Darthawk™. These Terms and Conditions ("Terms") are a legal agreement between you and Pattern Realms LLC. They explain the rules for using our software and services.

For definitions of capitalized terms, see the Definitions section at the end of this document.

1. License & Eligibility

1.1 U.S. Citizens or Residents Only

The software is licensed strictly for use by citizens and legal permanent residents of the United States of America and its territories. This restriction is necessary to ensure compliance with U.S. export regulations regarding artificial intelligence and related software technologies.

Outside the U.S.: If you access or use the software from outside the United States, you are subject to immediate removal of service or disabling of software at our sole discretion.

1.2 Age Restriction (13+)

You must be at least 13 years old to use this software. If you are under 13, you are not permitted to use the Services or provide any personal information.

Why? This restriction ensures compliance with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect data from children under 13.

1.3 Wellbeing Mandate

You agree to use this software to advance the productivity, prosperity, and wellbeing of individuals, society, and the natural world.

1.4 Eligibility & Export
You represent that you (a) are a U.S. person (U.S. citizen or lawful permanent resident) OR your use complies strictly with U.S. export laws, and (b) are not located in, under control of, or a national/resident of any embargoed country or on any U.S. restricted list.

1.5 Account Security
You are responsible for keeping your account credentials (power-up key, userid, password, etc.) secure. Pattern Realms LLC is not responsible for any loss or damage resulting from your failure to protect your login information.

1.6 License Grant
Subject to these Terms, Pattern Realms LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for your personal or organizational use.

1.7 Updates & Beta Features
We may update features at any time. Pre-release or "Beta" features are experimental and may be substantially modified or withdrawn.

1.8 Termination
We reserve the right to suspend or terminate your access to the Services at our sole discretion, at any time, for any reason or no reason, with or without notice. You may terminate this agreement by deleting your account and uninstalling the software.

1.9 Service Availability & Discontinuation
We reserve the right to modify, suspend, or discontinue any part of the Services (including online sync, authentication, and database hosting) at any time, for any reason, without prior notice or liability. You acknowledge that while the local "offline" functionality of the Software may continue to operate, online features are not guaranteed to remain available indefinitely.

1.10 Legacy Pledge
Pattern Realms LLC is committed to the long-term preservation of your knowledge. In the event of the company's dissolution or long-term cessation of operations, it is our intent to make commercially reasonable efforts to ensure that the local, offline version of the Software remains functional for existing users, or to release the source code under an open-source license. This clause represents a statement of intent to protect user data sovereignty, not a binding guarantee of perpetual maintenance.

1.11 "Buy Once, Keep Forever" Scope
The term "buy once, keep forever" applies to the current major version number of the offline version of the code and does not include future online services.

2. Your Content & Ownership

2.1 You Own Your Work
Pattern Realms LLC claims no ownership over the content you create. What you write, build, or design is 100% yours.

If you submit feedback, you agree that we are free to use it without restriction or compensation.

2.4 License to Host
You grant Pattern Realms LLC a license to host, store, and display your content solely to provide the Services to you and viewers you authorize.

3. Trusted Knowledge Policy

To maintain a trustworthy ecosystem, content in the Knowledge Cosmos is categorized into three distinct types:

Trusted Content:

Information that is claimed and proven to be true, as well as theoretical models where all constituent elements are true and the logical structure is valid. This content must be supported by verifiable evidence, endorsed by reputable experts, or have passed a rigorous process such as scientific peer review.

📖
Storyteller Content:

This category encompasses everything else. It includes fiction, fantasy, games, simulations, unproven theories, personal opinions, and early-stage research. Everything not explicitly Trusted is Storyteller Content Knowingly mislabeling Storyteller Content as Trusted Content is a direct violation of these Terms.

False Content:

Content originally presented as Trusted that was later proven to contain false facts, misleading claims, or used poor procedures to claim truth. Knowingly mislabeling False Content as Trusted Content is a direct violation of these Terms.

User Responsibility & Appeal: Under this policy, you may publish a story that has a theory that a specific person breaks the law, and describe a chain of false facts that support it. If this is labeled as Storyteller Content, it is fair use; however, if you claim the story and facts are Trusted Content, then you created False Content.

3.1 Prohibited/Offensive Content
We may remove content that is unlawful, harassing, exploitative, incites violence, constitutes doxxing, or infringes IP. Content deemed offensive to the board or Founder, at their sole discretion, may also be removed.

3.2 Academic Integrity
The Knowledge Cosmos is designed to assist learning, not replace it. Users agree not to use the Software to generate fraudulent academic work, plagiarize content, or violate the academic honesty policies of their educational institutions.

4. Proprietary Rights & Restrictions

4.1 No Reverse Engineering
You must not reverse engineer, decompile, or disassemble the Software except to the limited extent applicable law expressly permits.

4.2 Proprietary Technology
Portions of the software including the Darthawk™ markdown and directive language are proprietary technology of Pattern Realms LLC. You are licensed to use it within our ecosystem, but you may not clone its internal logic to build competing tools.

4.3 System Abuse
You agree not to: (a) interfere with or disrupt the integrity or performance of the Services; (b) attempt to gain unauthorized access to the Services or related systems; (c) use any automated means (bots, scrapers) to access the Services; or (d) bypass any license key validation or security measures.

5. Disclaimers & Limitation of Liability

5.1 No Warranty
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATTERN REALMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

5.3 Liability Cap
In no event shall our total liability exceed $100 USD or the amount you actually paid for the software, whichever is less.

5.4 No Refunds
All sales are final unless required by law.

5.5 High-Risk Use
The Software is not designed for high-risk environments (e.g., life-support, nuclear facilities) where failure could lead to death or severe damage.

5.6 No Professional Advice
Content within the Knowledge Cosmos, even if labeled "Trusted," is for informational purposes only. It does not constitute professional medical, legal, financial, or engineering advice. Do not rely on the Software for critical decisions; always consult a qualified professional.

5.7 Photosensitivity Warning
The Software may contain flashing lights, rapid image sequences, or patterns which may trigger seizures in people with photosensitive epilepsy. Viewer discretion is advised. If you have a history of epilepsy or seizures, consult a doctor before use. Immediately stop use and consult a doctor if you experience any symptoms.

6. Privacy & Data

6.1 Minimal Data Collection
We collect only what is necessary: Payment info, usage time, and service logs. User content is reviewed only if required to resolve issues.

6.2 No Built-In AI Surveillance
There is no built-in AI observing your work. We do not use your data to train our internal AI models unless you explicitly opt in.

6.3 Announcements/Ads
We may show contextual announcements. We do not use sensitive personal data for targeting, and we do not behaviorally target minors.

6.4 Right of Removal
We can remove your account upon request, but we cannot delete content stored on your local devices or third-party clouds.

6.5 Age Limitation (13+)
The Services are not intended for children under 13. You must be at least 13 years of age to use the online features of the Software. This restriction is mandated by the Children's Online Privacy Protection Act (COPPA) and related regulations. Any account found to be in violation of this restriction will be terminated and all associated data permanently deleted.

6.6 Educational Use
If you are using the Software in an educational setting (e.g., a classroom), you acknowledge that Pattern Realms LLC acts as a "School Official" with a legitimate educational interest under FERPA (Family Educational Rights and Privacy Act) only to the extent that we process data on your behalf. We do not sell student data or use it for behavioral targeting.

6.7 Legal Disclosure
We may disclose your information if required by law, subpoena, or court order, or if we have a good-faith belief that disclosure is reasonably necessary to: (a) comply with a legal process, government request, or investigation (including those related to national security or law enforcement); (b) enforce these Terms; (c) respond to claims that content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Pattern Realms LLC, its users, or the public.

7. Third-Party Software & Services

7.1 Open Source Components
This software includes components from open-source projects. Licenses are available in the software’s About section.

7.2 Third-Party Infrastructure
The Software relies on third-party services (including but not limited to Supabase) for authentication, database hosting, and storage. Pattern Realms LLC is not responsible for service interruptions, data loss, or security breaches originating from these third-party providers. We do not control their operations, and your use of the Software acknowledges this dependency.

8. Dispute Resolution

8.1 Binding Arbitration
Disputes will be resolved by binding arbitration on an individual basis in Michigan under JAMS rules.

8.2 Small Claims & Class Action Waiver
You may bring individual claims in small-claims court in Emmet County, Michigan. You agree to waive any right to class action proceedings.

8.3 Governing Law
This Agreement is governed by the laws of the State of Michigan.

8.4 30-Day Opt-Out
You may opt out of arbitration within 30 days of first acceptance by emailing patternrealms@ebeyond.com with the subject "Arbitration Opt-Out," including your name and account email.

9. Indemnification

You agree to indemnify Pattern Realms LLC against claims arising from your misuse of the software, your content, or your violation of these Terms.

10. Copyright & DMCA Notice

10.1 Digital Millennium Copyright Act (DMCA)
We respect intellectual property rights. If you believe your copyrighted work has been infringed on our platform, please send a notice to our designated agent at patternrealms@ebeyond.com including: A description of the copyrighted work, the location (URL or path) of the infringing material, your contact information, and a statement that you have a good-faith belief the use is unauthorized.

10.2 Counter-Notice
If your content was removed and you believe it’s not infringing, send a counter-notice to patternrealms@ebeyond.com including your contact info, the removed material, a statement under penalty of perjury that the removal was a mistake, and consent to jurisdiction in Michigan.

11. General Provisions

11.1 Updates to Terms
We may update these Terms at any time. Continued use of the software constitutes acceptance of the new terms.

11.2 Severability & Entire Agreement
If any part of these Terms is invalid, the rest remains in effect. This is the entire agreement between us regarding the Software.

11.3 Force Majeure
Pattern Realms LLC is not liable for failure to perform obligations due to causes beyond our reasonable control (e.g., natural disasters, war, internet service provider failures, or government acts).

11.4 Assignment
You may not assign or transfer these Terms without our prior written consent. Pattern Realms LLC may assign or transfer these Terms, in whole or in part, without restriction (e.g., in the event of a merger, acquisition, or sale of assets).

11.5 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Pattern Realms LLC.

11.6 Survival
Sections regarding Ownership, Proprietary Rights, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution shall survive any termination of these Terms.

11.7 Notices
Any notices or other communications provided by Pattern Realms LLC under these Terms, including those regarding modifications to these Terms, will be given: (i) via email; or (ii) by posting to the Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

12. Acceptance

By installing, accessing, or using the Knowledge Cosmos ecosystem, you agree to be bound by these Terms and Conditions.
